1. Introduction
1.1 Why a personal data charter?
The purpose of this Personal Data Protection Charter is to inform users of the site (hereinafter referred to as "the User" or "Users") of the use of their Personal Data on the site www.maisondartgallery.com (hereinafter referred to as "the Site" or "Maison D'Art"), in the context of :
• General Data Protection Regulation (EU) 2016/679,
• French Data Protection Act of 6 January 1978, as amended,
• Law no. 1.165 of 23 December 1993 on the protection of personal information as amended in Monaco.
We have tried to simplify this charter as much as possible in order to provide you with clear and transparent information on how your personal data is collected, processed and used.
In any event, the Site undertakes to comply with the following four essential principles:
• Collect only data that is strictly necessary for the purpose for which it is to be used
• The User remains the owner of his/her personal data
• Data is processed transparently, confidentially and securely
• Data is kept for no longer than is necessary for the purposes for which it is processed.
1.2 What is personal data?
Personal data is any information that directly or indirectly identifies a natural person. For example, a name, postal or e-mail address, telephone number or IP address is personal data.
1.3 Who is responsible for data processing on the Site?
Personal data is collected and processed by Maison D'Art, a company in personal name registered with the Trade and Industry Register of Monaco under number 03P06793, with its registered office at 27 avenue de la Costa - 98000 MONACO.
The data controller is the person or body who determines the purposes and methods of collecting and processing your personal data.

2. When is your data collected?
Your personal data is collected:
1. When you browse the Site by means of tracers or cookies ;
2. When making a purchase or a quotation on the Site or by telephone;
3. When you subscribe to the newsletter ;
4. When sending messages to Maison D'Art and its partners via the contact form on the Site, by email or by telephone;
The fields marked with an asterisk are mandatory. If they are not completed, Maison D'Art will not be able to respond to your request.
3. Why do we collect your data?
1. The processing of personal data generated by the deposit and reading of cookies during your browsing on the Site is used for :
• To ensure the functioning of the Site on the basis of Maison D'Art's legitimate interest in allowing you to benefit from the Site's functionalities;
• To measure the Site's audience and draw up anonymous visitor statistics on the basis of Maison D'Art's legitimate interests;
• To improve the functionality and personalisation of the Site on the basis of your consent, which you may withdraw at any time;
• To adapt the advertising content displayed according to your centres of interest on the basis of your consent, which you may withdraw at any time, and to ensure the interactivity of the Site with social networks on the basis of your consent, which you may withdraw at any time.

2. The processing generated during the act of purchase or during a quotation on the Site is used for :
• To supply the products and services purchased and the associated after-sales service on the basis of the performance of the sales contract,
• To manage fraud, in particular payment fraud and payment incidents based on the legitimate interests of Maison D'Art. Depending on the results of the fraud risk check carried out on orders, it will be possible to take security measures, cancel orders or prevent orders from being placed.
• To assess customer satisfaction with the purchasing experience, on the basis of Maison D'Art's legitimate interests.
• Send commercial offers from the Site for products similar to those of your last purchases, unless you object.
3. The processing carried out when you subscribe to the newsletter is intended to send you information and commercial offers from the Site on the basis of your consent, which you may withdraw at any time.
4. The processing generated when you register for the Internet customer account is intended to provide the functionalities of the Internet customer account, including the provision of targeted and personalised offers, on the basis of your consent, which you may withdraw at any time.
5. The processing generated when messages are sent to Maison D'Art via the contact form on the Site or via the call centre is based on Maison D'Art's legitimate interest in responding to the requests you make.
Explanations on profiling and automated decisions :
- When you register for an Internet customer account, your browsing on the Site is profiled in order to adapt the commercial offers sent to you. This profiling enables us to suggest travel offers that best match your tastes, previous purchases or interests, from among the thousands of travel offers available for sale. These suggestions are offered on all possible media, depending on the authorisations you have given for their use (email, sms, etc.).
- The data used for profiling is that which you have provided to us directly, that which is generated by your activity on the Site and that which is derived or inferred from the above.
In general, data may be collected for explicit, legitimate and specific purposes in order to ensure :
• The smooth operation and ongoing improvement of the Site, its services and its functionalities;
• Order management ;
• Managing the user's subscription to the Site's newsletter;
• The provision of a personal space on the Site;
• Events organised by Maison D'Art;
• Management of requests for access, rectification and opposition rights, deletion, limitation, portability, the right to be forgotten and the right to lodge a complaint with the Commission Nationale de l'Informatique et des Libertés (CNIL) in France, or with the Commission de Contrôle des Informations Nominatives (CCIN) in Monaco;
• Compliance with legal obligations ;
• Commercial statistics.
In any event, and for each defined purpose, Maison D'Art will do everything in its power to ensure the security and confidentiality of the personal data entrusted to it, in compliance with the Laws and Regulations in force.
4. Who has access to your personal data?
The personal data collected on the Site is intended, within the limits of their responsibilities, for
(i) the internal departments of Maison D'Art, its subcontractors and, if you have given your consent, (iii) Maison D'Art's partners.
More specifically, the recipients of your personal data are as follows:

2. At the time of purchase or at the time of a quotation on the Site :

In the event that you consent to receive commercial canvassing exclusively from the Site, only the internal departments of Maison D'Art and the partners responsible for the services selected by the Customer will have access to this data.

Your personal data will only be communicated to third parties in order to comply with the legal and regulatory obligations of Maison D'Art, in particular in the event of a request from a government department or a judicial authority.
5. How long will the data be kept?
The principle of limiting data retention means that the personal data collected cannot be kept indefinitely in a form that allows the data subjects to be identified.
Anonymisation is a technique consisting of "removing any identifying character from a set of data". According to ISO 29100, it is "the process by which personally identifiable information (PII) is irreversibly altered so that the subject of the PII can no longer be identified directly or indirectly, either by the controller of the PII alone or in collaboration with any other party" (ISO 29100: 2011).
Your personal data will be kept for as long as is necessary to fulfil the purposes described above:
o 13 months for cookies from the time they are placed on your computer or terminal;
o 3 years from the last expression of interest by the user, for data relating to identity, contact details and any other information voluntarily provided by the user, in particular relating to choices, preferences and behaviour;
o 4 years for technical connection logs from the last connection;
o 6 years for identification data from the date of conclusion of the travel contract;
o 10 years for invoices and accounting documents from their date of issue;
o Where applicable, for the duration of any disputes and until all avenues of appeal have been exhausted.
6. How can you exercise your rights with regard to your personal data?
In accordance with the amended Data Protection Act and the RGPD, the User has the following rights:
• Right of access (article 15 of the RGPD) right of rectification (article 16 of the RGPD) right to update and complete data
• The right to block or erase personal data (Article 17 of the RGPD) if it is inaccurate, incomplete, ambiguous, out of date, or if its collection, use, communication or storage is prohibited.
• Right to withdraw consent at any time (article 13-2 of the RGPD)
• Right to limit data processing (Article 18 of the RGPD)
• Right to object to data processing (Article 21 of the RGPD)
• The right to portability of the data supplied, where the data is subject to automated processing based on the User's consent or on a contract (Article 20 of the RGPD)
• Right to lodge a complaint with the CNIL (Article 77 of the RGPD)
• The right to define the fate of the data after the death of the User and to choose whether or not the data should be communicated to a third party designated by the User. In the event of the User's death and in the absence of any instructions from the User, Maison D'Art undertakes to destroy the User's data, unless it needs to be kept for evidential purposes or to comply with a legal obligation.

Users have the right to access, rectify, erase or delete all or part of their Personal Data, the right to object, and the right to limit the processing and portability of their Personal Data. For processing based on the collection of the User's consent, the User also has the right to withdraw his/her consent at any time.
Such requests must be made by the user personally and in writing, signed and accompanied by a photocopy of an identity document bearing the holder's signature.

The User is advised that exercising these rights does not affect the validity of the processing operations carried out previously, nor Maison D'Art's right to archive some of the Personal Data in question, in accordance with the principles set out above.
The rights previously granted to you lapse on your death. You have the right to define directives relating to the conservation, deletion and communication of your personal data after your death.
Where your personal data is processed with your consent, you may revoke it at any time. You are informed, however, that any processing carried out prior to such revocation will remain valid.

Maison D'Art takes the utmost care to protect personal data. Nevertheless, if you consider that your rights have been infringed by the processing of your personal data or that your request has not been satisfied, you have the right to lodge a complaint with the Commission Nationale de l'Informatique et des Libertés (CNIL) - 3 Place de Fontenoy - TSA 80715 - 75334 PARIS CEDEX 07 in France, or with the Commission de Contrôle des Informations Nominatives (CCIN) - 11 rue du Gabian - Immeuble " Le Concorde " - 98000 MONACO in Monaco.
7. How can I stop receiving commercial offers by e-mail or SMS?
If you agree to receive commercial offers, you can ask not to receive this type of information at any time:
• By clicking on the unsubscribe link provided in each email you receive,
• By sending your request via the contact form on the Site or by email to the above address,
• By replying STOP to the text message you receive.
8. What security and anti-fraud measures are in place?
Maison D'Art and any subcontractors undertake to implement all technical and organisational measures to ensure the security of the processing of personal data and the confidentiality thereof, in accordance with the French Data Protection Act (Loi informatique et Libertés) and the European Data Protection Regulation (RGPD) and Law no. 2018-133 of 26 February 2018. Maison D'Art ensures that such measures are put in place for all operations carried out in the context of processing, and in particular during the collection of Personal Data, its storage and hosting.
In this respect, Maison D'Art also ensures that any third parties it may call upon comply with this requirement to protect the User's Personal Data by implementing appropriate measures. The technical and organisational measures put in place may include the use of secure registration forms, encryption of certain data (such as bank details), and restricted access to Personal Data.
9. How is your personal data used by social networks?
The Site uses plug-ins from social networks, in particular Facebook, Instagram, etc. (hereinafter and together the "Social Networks").
If you interact on the Site by means of these plug-ins, for example by clicking on the "Like" or "Share" button, the information linked to your browsing on the Site and your membership of these social networks will be transmitted, recorded and processed on a server of the company operating the Social Network concerned and linked to your user account, in accordance with the terms of use specific to that Social Network.
If you do not wish your personal information to be transmitted from the Site to the Social Networks, we recommend that you :
• Not to interact with these Social Networks by clicking on the plug-ins made available to you on the Site,
• Deactivate your account on the social network in question before browsing our Site,
• Browsing in "Private" mode via your browser.
10. How are cookies managed?
10.1 What is a cookie?
A cookie is a file stored on your computer's hard drive at the request of the server managing the website visited. It contains information about your browsing of the site's pages. The purpose of the cookies deposited during a visit to the Site is to ensure that it functions optimally by storing the user's information for the duration of the session, to enable audience measurement statistics to be compiled and advertising tailored to your interests to be sent out, and to improve the interactivity of the site via the social networks.

Maison D'Art informs the User that its Site is up to date with the new obligations in terms of cookies, namely :

• Users can easily withdraw their consent at any time in a succinct and effective manner;
• The User can easily accept or refuse cookies;
• Bring to the User's attention the purposes and consequences of accepting or refusing cookies;
• To inform the User of the identity of all parties using cookies subject to consent;
• Implementation of processes so that the User's free, informed, specific and unambiguous consent to cookies can be proven at any time.
Maison D'Art uses cookies when the User browses the Site. These cookies are used to measure the number of visitors to the Site, to provide Maison D'Art information on how the User uses the Site, and to improve the User's experience on the Site (for example, to save the contents of the User's shopping basket from one visit to the next). The cookies used by Maison D'Art are stored for a maximum period of thirteen (13) months from the time they are first placed on the User's computer.
It is also possible that third parties use cookies in order to collect data related to the User's browsing. Maison D'Art is in no way responsible for operations linked to the use of third-party cookies. The User has the possibility of configuring the operation of cookies installed on his/her computer by configuring the settings of his/her browser. If the User chooses to deactivate or block certain cookies, the associated functionalities (for example, personalising the browsing experience on the Site) cannot be applied.

11. Transfer outside Monaco and the European Union
Maison D'Art may transfer Users' data outside Monegasque territory and the European Union. In this case, it will inform the Users, indicating the measures taken to control this transfer and ensure that the confidentiality of their data is respected.
12. Modification of privacy policies
These confidentiality policies may be modified by Maison D'Art any time. In the event of a change to the confidentiality policies, the new version in force will be applicable to the User from the time of connection to the Site.
In the event of a dispute between the User and Maison D'Art, the confidentiality policy to be taken into account will be that in force at the time of the events giving rise to the dispute.
